State capture inquiry terms of reference to be released tomorrow

The department of justice has confirmed President Zuma has signed the terms of reference for the commission.


The department of justice and constitutional development (DoJ & CD) says the terms of reference for the much-awaited judicial commission of inquiry into allegations of state capture will be published on Thursday.

In a statement on Wednesday, the ministry said it was processing the publication of the terms of reference in the government gazette. The DoJ & CD also confirmed President Jacob Zuma on Tuesday had signed the proclamation to give legal effect to the terms of reference for the commission to be headed by deputy chief justice Raymond Zondo.

“The signed terms of reference are in the process of being translated into another official language as per the legal requirement. The publication is scheduled for release on 25 January 2018,” DoJ & CD spokesperson Mthunzi Mhaga said.

“The publication of these terms of reference will be followed by the release of the regulations which give the commission the legal competence to conduct the investigation. This includes the power of the chairperson to subpoena witnesses and of search and seizure.”

On Tuesday, Zondo bemoaned during a press conference that the commission could not go ahead with its work and appoint its evidence leaders until Zuma had set out its terms of reference.
