NUM to challenge clause in new Mining Charter

It is reported that following the release of the new Mining Charter by the mineral resources minister on Thursday, the National Union of Mineworkers (NUM) have said they will oppose a clause, while the Chamber of Mines say they were not consulted and would therefore challenge the charter in court.

The clause that would allow black citizens who became citizens through naturalisation to qualify for Black Economic Empowerment (BEE) ownership is what the NUM will oppose, reports EWN.

It was further reported that the union’s Luthando Brukwe said the clause could be “regressive” and thereby not contribute to the advancement of black South Africans, while mining lawyer Peter Leon also reportedly said it was an “inversion of the principle” that is contained in the equality clause of the Constitution.
