In our article titled “Two sue healthcare group for millions after botched eye operations” that was published on 6 June The Citizen incorrectly reported that the High Court in Pretoria had issued an order declaring that Netcare was liable for 100 percent of the damages suffered by Mrs Susan Botha as a result of an unsuccessful operation on her left eye at Netcare Pretoria East Hospital.
The article was written on the strength of court documents containing an incorrect court order due to an administrative mistake.
Netcare’s Communications Manager Marietjie Shelly pointed out that Botha had erroneously been provided with an interlocutory order for the discovery of certain documents as Botha’s application before court was heard as an unopposed application.
However, as Netcare had earlier filed an Intention to Oppose the application, the application should not have been heard on the unopposed court roll at all. The order issued erroneously will be rescinded.
“Mrs Botha did not succeed with her claim against Netcare as was reported. A trial date still has to be set,” she said.
