Advocate Tembeka Ngcukaitobi has secured a legal victory for his clients Amanda Dupont and Masechaba Khumalo after Jub Jub’s mother, Jackie Kabi Mpambane (popularly known as Mama Jackie) filed an urgent interdict against the pair in an effort to have their social media posts about her son taken down.
This comes just weeks after she demanded an apology from the Dupont and Khumalo.
Among the laundry list of demands included in her application, Mama Jackie wanted Dupont to take down the video she posted on 2 December 2021 in response to statements made about her by Jub Jub in his episode of Podcast and Chill with MacG that aired on Channel O and was subsequently posted online in early December.
Mama Jackie also wanted her to retract statements she allegedly made accusing her of using witchcraft (muthi) to drug and/or influence Dupont.
EWN reports that the High Court in Johannesburg struck Mama Jackie’s urgent application off the roll.
Mama Jackie reportedly told the court she was not trying to silence the allegations against her son, she just wanted her name removed from the social media posts containing the allegations.
During court proceedings, her lawyer, Vicky Olivier, reiterated the reasons her client listed in her application to highlight her reasons for wanting the application granted.
Olivier argued that Mama Jackie’s life had been threatened by strangers who believed that she practised witchcraft, and had used her influence to shield her son from facing the consequences of his transgressions against the respondents.
Ngcukaitobi, on the other hand, argued against granting the interdict against his clients, as it would be tantamount to silencing them, further impeding their attempts to seek justice.
The proceedings concluded with the court dismissing Mama Jackie’s urgent application with costs.
