Nkandla cop in court for murder

It is alleged that an argument ensued between the accused and four other men, one of whom apparently assaulted him

A POLICE officer accused of shooting to death a 27-year-old man at the Nkandla petrol station last Monday, is expected to appear in the Nkandla Magistrate’s Court tomorrow (Friday) for a bail application.

Constable Buyisani Biyela (28), based at Nkandla SAPS, is accused of killing Fisokwakhe Duma.

Independent Police Investigative Directorate (IPID) spokesperson, Ndileka Cola, said Biyela was driving back home after work when he stopped at the garage to buy food.

‘While he was outside the petrol station’s kiosk, he requested the cashier to assist him while he waited outside, as he was not wearing a mask.

‘It is alleged that an argument ensued between him and four other men, one of whom apparently assaulted him.

‘Biyela pulled his service pistol and fired several shots. Duma was fatally wounded and three other men ran away,’ Cola said.

A case of murder was registered at Nkandla SAPS and a postmortem was conducted at eShowe Hospital on Tuesday.

‘Biyela was arrested on Tuesday and made his first court appearance on Wednesday. He was remanded in police custody for further investigation,’ Cola said.
