Court overrules claims of insanity

It is believed the Macekane man threw a knobkierie at his father, Bhekumuzi, during a domestic dispute, which struck him on side of head, killing him instantly

JABULANI Biyela will spend a decade in prison for killing his father with a knobkierie, despite witnesses testifying to his history of mental illness.
The Empangeni Magistrate’s Court recently sentenced him to 10 years imprisonment for the murder, which took place in June last year.
It is believed the Macekane man threw a knobkierie at his father, Bhekumuzi, during a domestic dispute, which struck him on side of head, killing him instantly.
Witnesses, including his mother, stated he had a history of mental illness and was receiving treatment.
They claimed he was susceptible to random, unpredictable bouts of intense anger which brought him to violence.
However, after doctors at Pietermartizburg’s Fort Napier Hospital found him to be mentally sound, the court disregarded the possibility and opted to sentence the 33-year-old based on the seriousness of the offence.
