Richards Bay medical ‘malpractice’ case back in court in June

It is believed Vandayar had passed away from complications following routine surgery, allegedly the consequence of medical negligence

The matter involving the death of Richards Bay wife and mother Monique Vandayar (35) has been postponed to 7 June for statements from hospital doctors and other documents.

The accused charged with her murder, Dr Avindra Dayanand appeared in the Richards Bay Magistrate’s Court on Monday.

The 43-year-old medical professional was charged in August, two years after the death of Vandayar on 22 August 2019.

It is believed Vandayar had passed away from complications following routine surgery, allegedly the consequence of medical negligence.

Queries were raised by the National Director of Public Prosecutions requesting reports from the medical council, formal affidavits from hospital doctors, expert witness and medical professionals.

In addition, the defence team for the accused confirmed that the postponement delay would allow for evidence relating to the case to ensure queries are attended to and resolved.

The medical council outcome from their inquiry is still awaited as there was no sanction from them at the time while outside expert witnesses will need time to assess all the evidence on a way forward to proceed.

Meanwhile, the husband of the late Monique Vandayar, Gary said it has been an emotional time for the family and they will await the next court appearance.
