Suspected property fraud in Mtubatuba

A property scheme within Mtubatuba Municipality was uncovered just days before former Administrator Bamba Ndwandwe left office.

FORMER Mtubatuba Municipal Administrator, Bamba Ndwandwe, may have left office but the alleged property scheme he uncovered just days before his departure is the subject of intense investigations.

KwaMsane is a municipal-owned township whose vacant land cannot be bought and sold.

The national Township Ownership Scheme, which applies to KwaMsane, is limited to allowing occupants of houses to become homeowners after more than five years’ occupation.

For those who qualify, a Deed of Grant is issued by the local municipality. Ndwandwe has made provision for this in this year’s budget.

The alleged KwaMsane property scheme came to light when a person who has been paying rates on a plot of vacant land approached the municipality after a third party was seen fencing off his land.

Investigations revealed the same plot of land had been sold and transferred to more than one party at the same time.

Ndwandwe made an urgent application to the High Court to suspend ownership of the land, pending the case going to court.

An investigator has been appointed to look into all plots of land that have been transferred to purchasers by Mtubatuba Municipality in the last five years.

Ndwandwe said the only time municipal-owned vacant land can be sold and transferred is after a full council resolution has been reached and the land in question has been proven to not be required by the municipality.
