You can be charged with murder if you don’t tell your partner you are HIV positive

If you are in a relationship, have yourself tested regularly and make sure you practice safe sex - keep you and your partner safe.

If you fail to disclose your HIV status, your partner may have grounds to sue you. This is true even if you do not transmit HIV to your partner because you put them at risk. For a civil lawsuit, the main requirement is that the partner has HIV/Aids and was aware of it.

But according to Captain Eddie Hall, head of corporate communications Witbank SAPS this can even go further, “ if you have sex with someone without informing the person that you are HIV positive you can actually be charged with attempted murder and if that person dies you can be charged with murder.”

In a recent incident reported at Witbank Police Station, the complainant alleges that she met a certain guy in 2019 and they started dating. Before their relationship got serious she asked him about his status and he told her that he was negative. They continue with their relationship and even had sex without protection.

In February 2020 she suspected that the guy was cheating and he asked him and he said that he had an affair since 2016 with someone. She then decided to go and do an HIV test again…. the result was positive.
