Dr Van der Walt who is out on R10 000 bail will remain free pending the appeal.

Magistrate Merlene Greyvenstein handed down his sentence on Thursday, July 27 and sentenced the gynaecologist to five years imprisonment.

She said Dr Van der Walt failed to do everything a specialist of his calibre should have done to save the life of Pamela Daweti in August 2005.

Greyvenstein said that Dr Van der Walt did not show any remorse during the trial.

She pointed out that she took into account that Pamela’s bleeding was not necessarily caused by Dr Van der Walt. She acknowledged him for being a respected specialist and considered, amongst other things, that he has no previous convictions.


Dr Danie van der Walt was sentenced to five years for culpable homicide.

“But I hold a view that a community-based sentence will not be correct. I’m of the view that the most balanced sentence will be that of imprisonment,” Greyvenstein said.

State prosecutor Francois Brandt said it was evident from the start of the trial that the degree of culpability on the part of Van Der Walt was not of a slight nature. He asked the court to impose a prison sentence.

Dr Van Der Walt’s legal representative, Advocate Mike Helens, asked the court to impose a suspended sentence coupled with a fine on his client during earlier court proceedings.

It has been 10 months since Greyvenstein found Dr Van der Walt guilty on September 21.
