The baby was found in a dumpster in the Central Business District (CBD) on June 19 when sanitation workers were making their daily rounds.

The body of the child seemed to indicate it was very far along in development if not to term. The spine chilling reality is that this is the second case in the last seven days that the police are investigating.

“We don’t give a killer or rapist the death penalty but it is legal to decide whether an unborn baby lives or dies in a womb,” said an outspoken resident of eMalahleni.

The law favours the pro choice camp however. The Choice on Termination of Pregnancy Act was passed in 1997 in South Africa, providing abortion on demand for a variety of cases. Any woman of any age can get an abortion, if she is less than 13 weeks pregnant. It was amended in 2008 to allow legal abortion up to the 20th week which is about five months.

Many studies published online, labels the situation as a culture of illegal abortion, and a “pandemic”. However no matter the range of opinions and studies being done, seeing an unborn baby with a broken neck in a dumpster is a dreadful thing to behold. It was visible on the faces of the small crowd of people gathered behind the yellow tape as pathology services attended the scene to remove the body.
