The Premier of Mpumalanga, the Provincial Executive and the National Executive all received their letters of demand from local attorney Mr Johan Coetzee earlier this week to comply with their constitutional obligations and to intervene in the affairs of the Municipality in terms of Section 139 (5) of the Constitution, before October 31.


Local attorney, Mr Johan Coetzee is keeping government responsible for the situation in Emalahleni.

Coetzee confirmed that all the substantive requirements for a mandatory intervention in terms of section 139(5) of the Constitution have been present since before 2013. With the full knowledge of the all the responsible roll-players, the municipality had been in serious and persistent breach of its obligations to provide basic services and to meet its financial obligations for a long time. The Provincial Executive and the National Executive were in terms of section 139(5) of the Constitution obliged to intervene into the affairs of the municipality, which they failed to do.

An intervention in terms of section 139(5) will entail the imposing of a recovery plan, dissolving of the municipal council and the appointment a multidisciplinary panel of suitably qualified and experienced administrators.

Coetzee also handed over a comprehensive submission on behalf of the community to Eskom on October 18.
