High Court rules on state’s appeal

The state’s appeal of Springs businessman Retief Liebenberg’s verdict in the double murder case when he shot Dewald ‘Poenie’ Visser (19) and his father Dewald Visser (46) in his Ebotse, Benoni home on October 31, 2012, was denied.

The application was denied by Magistrate Mohamed Ismail in the Pretoria High Court on Monday.

Liebenberg (50) was acquitted of murder by Ismail in November last year.

Ismail found the shooting was an involuntary act that was performed in a state of unconsciousness, meaning that Liebenberg was not fully aware of his actions while in this state.

Liebenberg says they can now focus on the future and put the case behind them.

He was arrested on the same day he shot dead his daughter’s boyfriend and the boyfriend’s father.

Poenie was shot four times and his father five times.

According to private investigator Danie Day, Liebenberg’s daughter was in a relationship with Poenie before the shooting, a relationship that had gone sour.

“She was terrorised by Poenie and was very scared of him,” he says.

Liebenberg was arrested on the same day of the shooting.

He says he has always stayed on his knees and continued to do so throughout the trial.

“This incident caused my family a lot of emotional harm. However, I am grateful that it is finally over.

“I would like to thank my family, all my friends and my legal team for their support,” he adds.
