Aurora directors hear their fate in high court

Judge Eberhart Bertelsman handed down judgement today in North Gauteng High Court 8E on the Aurora Empowerment Systems, which is based in Grootvlei, civil case which has been going on since 2011.

He found Aurora directors Zondwa Mandela, Khulubuse Zuma, Thulani Ngubane and business associates Sulliman and Fazel Bhana guilty of willful deception and recklessness in managing the Pamodzi Gold Mine, which it took over in 2009, and were liable for all costs.

However, Zuma is in a slightly different position to the others in that he should only be held liable for losses that were incurred since December 1, 2009.

Bertelsman said all were found guilty in their personal capacity and that they are all liable for payments and judgements.

The case stems from a lack of salary payments when the liquidated Pamodzi Gold Mine was taken over by Aurora.

The workers claim they weren’t paid in full from March 2010 to May 2011, whereafter they were told to stay at home without any warning.

The Aurora directors are personally liable for Aurora’s debt on the basis that they were negligent and dishonest directors.

They are accused of stripping the assets of the liquidated Pamodzi Gold mines in Springs and in Orkney, in the North West.
