The ward (44) Cllr appeared before the Roodepoort Magistrate’s Court where it was ruled that the matter be withdrawn.

This comes after the National Prosecuting Authority (NPA) decided not to have the matter placed on the roll.

“We received a docket wherein allegations of rape were made against an ANC member that was arrested in Bramfisherville, Soweto, however we did not place the matter on the roll due to the fact that the compliant was not certain about the identity of the perpetrator and therefore as the prosecution we declined to prosecute,” NPA Spokesperson, Phindi Mjonondwane said.

Police had detained the 44-year-old Cllr on a charge of rape after a 42-year-old female laid criminal charges.

It was reported that the victim alleged that the rape incident occurred in Bramfisherville just after midnight on Sunday, May 21, when walking from a tavern in the area, where she was approached by the alleged suspect.

According to Colonel Dimakatso Nevhuhulwi, the victim alleged that the man pointed at her with a knife and punched her with a fist on the face and forced her to undress and proceeded to rape her.

The suspect was arrested on the same day and was detained at the Dobsonville SAPS but has been released since the court ruling.
