Hlabangwane’s case postponed yet again

The 26-year-old Protea Glen man, Flavio Hlabangwane, who was allegedly found in possession of female body parts last year was meant to appear at the Protea Magistrate Court on Friday, February 18. However, the case was postponed to March 18, to allow the mental institution to complete its diagnosis report on his mental condition.

This follows a postponement which was made in January when he was meant to appear in court but couldn’t, the NPA’s Phindi Mjonondwane updated the media on the fact that Hlabangwane was admitted into the Sterkfontein Mental Institution on January 19, following an application by the defence team for him to undergo mental observation, which was not opposed by the state.

The Protea Magistrate Court granted the order after hearing evidence that Hlabangwane attempted to take his life on two occasions since his arrest after body parts were discovered inside a fridge in his rented back room in Protea Glen Extension 26.

“The court must ascertain that during the commission of the alleged offence, Hlabangwane did not suffer from any mental illness or intellectual disability rendering him incapable of appreciating the wrongfulness of his act that constituted an offence,” said Mjonondwane in the media statement she released.

“The report will assist the court as it is expected to include either a unanimous finding of the mental condition of the accused. A finding as to the extent to which the capacity of the accused to appreciate the wrongfulness of the act was, at the time of the commission of the alleged offence or, in the case where the finding is not unanimous, each specialist (psychiatrist, psychologist) shall give their findings on his mental condition,” she further explained.
