No new details emerge as lawyer for accused number one cross examine witness.

Cross examination gets underway in Nathaniel murder trial,

Caylene Whiteboy’s lawyer failed to discredit the witness on the first day of cross-examination in the Nathaniel Julies murder trial. The witness, Constable Mandla Sithole stuck to the same story he told the court at the start of his testimony on Tuesday.

The lawyer repeated questions that Sithole had already answered. “He has already testified about what happened. If you ask what happened, is that cross-examination?” asked Judge Ramarumo Monama to accused number one’s lawyer.

The judge went on to add that the court should not expect the witness to repeat what he had already said during his testimony.

In his testimony, Constable Sithole told the court that accused number two, Simon Ndyalvane instructed him to load the shotgun when they got to the scene.

They then sat in the car to eat while they waited for backup. How the gun moved from Sithole to Whiteboy remained the question.

“Mr Sithole, I put it to you that after you loaded the shotgun, it remained in your possession until you handed it to accused number one,” said Whiteboy’s lawyer.

“I don’t agree with that because I did not hand over the gun to accused number one. She took the gun herself, so I don’t know what you are talking about,” responded Sithole.

The lawyer also made a failed attempt at discrediting the cell phone recording Constable Sithole made on the day of the incident.

He first asked the intent for making the recording and when that didn’t work, he went on to ask if Constable Sithole agreed that electronic recordings could be manipulated.

Whiteboy’s lawyer went as far as asking the witness if he was aware that he is an accomplice in the matter since he is the one who loaded the gun.

The case continues.
