Nathaniel murder case postponed to December 8

Simon Scorpion Ndyalivana, Caylene Whiteboy, and Voster Netshiongolo are facing charges of murder, discharging a firearm in public, possession of ammunition, and defeating the course of justice.

Three police officers accused of killing Nathaniel Julies were back at the Protea Magistrate’s Court on Friday last week. The matter was postponed to December 8 pending further investigations.

Simon Scorpion Ndyalivana, Caylene Whiteboy, and Voster Netshiongolo are facing charges of murder, discharging a firearm in public, possession of ammunition, and defeating the course of justice.

In September, the three failed to convince the court to grant them bail and were remanded back to custody. Accused number three Voster Netshiongolo went back to court again late last month to launch another bail application bid based on “new evidence” but the matter was postponed to next month.

Last week’s postponement was the fourth one since the trio was arrested in August in connection with the murder of Julies who was living with Downs Syndrome. The defense team expressed readiness to proceed with the case. They appeared not happy with the fact that there were still outstanding investigations on the side of the state. One of the outstanding investigations on the side of the state includes the submission of the postmortem report.

Outside court, residents of Eldorado Park and the family of Julies were not happy with the postponement. They alleged that this might be a ploy by the accused and the court to delay justice.
His mother Bridgette Harris expressed her dissatisfaction with the snail pace the court case has taken saying it is adding more pain to her heart.

“Today it’s the postmortem and tomorrow it will be another story. As a mother, I’m really upset, I can’t even express my feelings right now, I’m very disappointed,” said Nathaniel’s mother adding that these postponements have taken a toll on her and the family.

Nathaniel’s grandfather, James Frank Julies shared the same sentiments and about the case taking a tall on the family.

“We can’t even move forward with our lives because of this case. There are so many things we want to do for Nathaniel but we can’t do them because of this case and all the postponements. Little things like the postmortem were supposed to have been done a long time ago. These people have killed my grandson and they have not even apologised for it but they are desperate to get bail,” lashed out Nathaniel’s grandfather.

16-year-old Nathaniel Julies were killed in august allegedly at the hands of police officers from the Eldorado Park SAPS. His death sparked a national outcry with residents calling for the overhaul of the whole police force in the area.

They marched to the police station and barricaded roads with stones and burning tires. The incident caught the attention of the Independent Police Investigative Directorate which promptly dispatched an investigator to look into the issue.
