Baby Nyiko’s murder case postponed

Bail application withdrawn by the accused.

The accused on the rape and murder case of Baby Nyiko Mthumunye appeared at Protea Magistrate court last week Thursday, February 11.

The case has been postponed, however, the accused will from now going forward appear in different courtrooms. This was after accused number one, who is the perpetrator withdrew his bail application statement stating he no longer wants bail. However, accused number two, who is the mother of the deceased is proceeding with her bail application.

The mother of the deceased will return to court on February 18, to apply for bail, the court has advised her to come with witnesses who will state if she should be granted bail or not.

The accused will be placed in a place of safety until her next court appearance. The case is still not open to the public because the accused is still a minor. This is in line with the Criminal Procedure Act section 154(3) which states that no person shall publish information that may reveal the identity of the accused or of a witness at criminal proceedings who is under the age of 18.

As accused number one has withdrawn his bail request, he will be detained in prison and will return to court on March 12.
