Conviction overturned from murder to culpable homicide

Oscar's case had no bearing on Jub Jub's reduced sentence.

On March 8 2010, Molemo Maarohanye known as “Jub Jub” and Themba Tshabalala crashed their cars into a group of pupils killing four and leaving two with permanent brain damage.

They were both sentenced for 25 years in prison for murder, attempted murder and driving under the influence of drugs.

After appealing for their convictions in June this year, the South Gauteng High Court ruled on October 8 that there were not guilty of murder but culpable homicide

While most people think that Oscar Pictorious’ verdict had an influence on Jub Jub’s conviction, legal experts state otherwise.

Emmanuel Masindi, who is an attorney, said that Oscar’s verdict had no influence on Jub Jub’s new sentence because he started to appeal before Oscar got convicted and it was evident that he would be successful in his appeal because he was wrongfully charged of murder instead of culpable homicide.

“The test that the state applied is the test of a reasonable man and didn’t dwell much on intentions,” said Masindi.

Jub Jub and Themba’s sentence have been reduced to 10 years with two years suspended and their new sentence starts from when they were first convicted.
