WATCH: Special Tribunal judge orders Lekabe’s pension to not be paid

Lekabe’s pension benefit is R4-million.

In his judgment at the Special Investigating Unit (SIU) Special Tribunal, Judge Mlindelwa Gidfonia Makhanya granted the order that the Government Employees Pension Fund (GEPF) is ordered not to pay the pension benefits to former head of the Office of the State Attorney Kgosi Lekabe and ordered him to pay the cost of the hearing.

This was the first tribunal sitting since it was established by President Cyril Ramaphosa in February last year. It was held at Booysens Magistrate’s Court on January 21.

Speaking to the COURIER, the spokesperson of the Special Tribunal, Selby Makgotho, said in this special sitting the SIU had brought in an application for a preservation order against the former head of the Office of the State Attorney in Johannesburg.

“The issue at dispute was the need to preserve the order so that he does not have access to his pension money.

“As we have the judgment being granted by the president of the tribunal, Judge Mlindelwa Gidfonia Makhanya, the order is that the GEPF is ordered not to pay the pension benefits to former head of the State Attorney Kgosi Lekabe, and secondly it ordered him to pay the costs occasioned by this activity as well as the costs of two counsel.

“In essence, we are delighted with the work of the tribunal. The tribunal is here for the next three years and we hope and believe that all systems are going from our side,” he said.

All this emanated from an investigation by the SIU into allegations of irregularities in the Office of the State Attorney, which is estimated at R34-million.

Advocate Dawie Joubert SC argued on behalf of SIU and also the ministers of police and justice while Lekabe’s counsel was advocate Desmond Brown.

Lekabe’s pension benefit is R4-m.
