Update: Daughter admits to lying about rape

The state had to withdraw charges of sexual assault against the Marburg father.

A MARBURG father has been exonerated after sexual assault charges against him were dropped.

The 34-year-old man is free after spending almost a month behind bars,  accused of sexually assaulting his 11-year-old daughter. The charges were dropped after his daughter admitted she had lied about the rape.

According to Director of Public Prosecutions (DPP), Advocate Moipone Noko, the child arrived at the Port Shepstone court with her mother days after bail was denied. “The child said that she wanted to report to the prosecution that she had lied about being raped by her father,” he said.

“She was referred for counselling to the forensic social worker before a statement was taken from her. After being counselled, she was still adamant that she had not been raped by her father. The state had to withdraw charges,” said Adv Noko.

He added that proceeding with the prosecution would have been tantamount to malicious prosecution.
