Under the gavel at the Scottburgh Magistrate’s Court

A man arrested for business robbery with aggravating circumstances as a firearm was involved, was released on R1000 bail.

Cases dealt with recently at the Scottburgh Magistrate’s Court included:

• A young man was arrested in Roseneath, Umkomaas on October 21 last year for driving under the influence of alcohol. The case was previously withdrawn because the forensic reports were awaited.

Representing himself, he told the court he believed he should not be charged because he drank the night before his arrest and claims that he did not get into his car drunk as he had sobered up by the next morning. Court officials explained that he should rather seek the help of an attorney to explain the arrest and court proceedings to him. The case was postponed to May 30 for statements and trial.

• An unemployed man from Malangeni made his first appearance after being arrested in the Umzinto District last week for being in possession of one capsule of heroin. He applied for bail and informed the court that he had appeared in court previously for being in the possession of dagga. He was warned for this offence and the case was withdrawn.

The state did not oppose bail and he was released on warning and is expected to reappear on June 21.

• A man appeared for bail application last Wednesday after being arrested for business robbery with aggravating circumstances as a firearm was involved. He has a pending case of armed robbery, with accomplices, for which he has not yet applied for bail.

He is a driving instructor and told the court that he needs to be released from custody so that he can take care of his pregnant girlfriend and support his child when it is born. The state opposed bail, as did the investigating officer who had a confession from the accused but no other evidence. He was released on R1000 bail and will appear in court again on June 12.

• A warrant of arrest was issued for a man who failed to appear in court on May 10. He was subsequently arrested and appeared in court on Monday, May 27. He faces charges of being in possession of an unlawful firearm as well as for being in possession of two rounds of ammunition. He applied for Legal Aid and is expected to reappear on May 30.
