Midvaal to take Ntha Property Developers to Court

Midvaal residents are urged to refrain from purchasing stands or houses from any of the mentioned properties.

MIDVAAL. – The Midvaal Local Municipality has initiated a litigation process against Ntha Property Developers. The Court proceedings will take place in February.
This comes after the municipality failed to get the developer to cease the illegal housing development taking place on Portion 116 of the Farm Elandsfontein 334 IQ since July last year.
Communication Officer Kagiso Korae says: “The Developer of this illegal housing development was requested to cease all construction activities and comply with the necessary Town Planning and Building Control processes to formalise the development.
“The Developer did not comply and to date, this housing development remains illegal as the required Town Planning and Building Control processes as legislated were not adhered to by Ntha Property Developers.”
Korae adds that the Developer is not even the registered property owner of the land.
Korae further states that it has come to the attention of the Municipality that Ntha Property Developers is now selling stands on Portion 108 of the Farm Elandsfontein 334 IQ.
“Similar to Portion 116 of the Farm Elandsfontein 334 IQ, the Portion 108 of the Farm Elandsfontein 334 IQ housing development is illegal, with no Town Planning and Building Plans applications submitted to the Municipality for consideration.”
Midvaal residents are urged to refrain from purchasing stands or houses from any of the above-mentioned properties.
“The properties being sold will never be transferred to the buyers and there is insufficient infrastructure to support the developments.
“Furthermore, there is no Certificate of Occupancy issued to confirm the structural quality of the buildings on Portion 116 of the Farm Elandsfontein 334 IQ.”
