Midvaal tells property developers to stop illegal activities

The Midvaal Local Municipality said that the households occupying these houses are at risk should there be any structural defects and incidences, given that no Certificate of Occupancy was issued.

MIDVAAL.- The Midvaal Local Municipality has instructed Ntha Property Developers to cease building on land in Elandsfontein, as this activity is illegal.
The municipality said that a meeting was held between themselves and and Ntha Property Developers regarding the illegal housing development taking place on portions 116 and 108 Elandsfontein, Midvaal.
“As per discussions from the meeting and information provided by Ntha Property Developers, the housing project remains illegal as there are no Town Planning (township establishment) and Building Control Applications submitted to the Municipality for consideration. Furthermore, there is no Water Use Licence, Environmental Impact Assessment, or Engineering Services Reports conducted on the properties. Since none of the above applications have been submitted, the developer is contravening the law by establishing an illegal township,” the municipality said.
There are apparently presently 23 houses illegally constructed on Portion 116 of the farm Elandsfontein 334 IQ.
The Midvaal Local Municipality said that the households occupying these houses are at risk should there be any structural defects and incidences, given that no Certificate of Occupancy was issued.
“The development requires access to roads, water, sanitation, and electricity supply to which the developer has not applied for. Communities will be compromised as no provision or planning was provided for.”
Based on the above, the municipality said that the developer has been requested by to cease all illegal activities on-site and follow the correct Town Planning and Building Control procedures.
“No construction should take place until the necessary approvals have been obtained from the Municipality. The Municipality has followed the litigation process and a Letter of Demand could not be served by the Sherriff as the registered owner of Portion 116 of the farm Elandsfontein 334 IQ is deceased. The Municipality’s Attorney has been briefed to approach the Court for an urgent interdict against the development.”
Midvaal residents are advised to refrain from purchasing stands or houses from the developer as the development is still illegal
