4 employees and their HR manager arrested for non-compliance at Sandton restaurant

Department of Labour made arrests while checking for compliance in Sandton City.

The Gauteng Department of Labour conducted compliance inspections in Sandton, which resulted in five arrests on September 18.

Four employees from a restaurant in Sandton, as well as the brand’s HR manager, were arrested for not having work permits, and valid documents to be in the country.

The department’s provincial inspector from the Office of Occupational Health and Safety at the scene, Advocate Michael Msiza, confirmed that five restaurants and one hotel received inspection visits. Inspectors were checking gas installation and risk assessment compliance.

“The HR manager was arrested as [their] employer,” said Msiza.

Furthermore, Msiza said that of the five restaurants visited during the operation, three of them weren’t paying their employees appropriately.

“The restaurants pay their waiters and waitresses in tips and commissions, which contravenes the national minimum wage act,” Msiza concluded, specifying that the Bargaining Councill Collective Agreement provides that minimum wage is R28.76 for waitrons.
