Secrecy Bill unconstitional – Zuma

GAUTENG - President Jacob Zuma has referred the Protection of State Information Bill, also known as the Secrecy Bill, back to Parliament.

This, to bring it in line with the Constitution.

Zuma pointed out certain sections which should be changed to ensure that the Bill passed the constitutional assembly.

“In particular Sections 42 and 45 lack meaning and coherence, consequently are irrational and accordingly are unconstitutional.”

Speaking to members of the Press Gallery Association at Parliament in Cape Town, Zuma said he had given consideration to the Bill in its entirety and the various opinions and commentaries regarding the constitutionality and tagging of the Bill.

“After consideration of the Bill and having applied my mind thereto, I am of the view that the Bill as it stands does not pass constitutional muster,” he said.

He explained that the Constitution required him to agree to and sign the Bill referred to by the National Assembly.

He said in terms of a section in the Constitution (section 79(1)), if the President has reservations about the constitutionality of the Bill, he may refer it back to the National Assembly for reconsideration.
