Mpianzi family lawyer says they will take both civil and criminal action

PARKTOWN – Ian Levitt said that people who refused to cooperate in the investigation could not hide forever.

Mpianzi family lawyer Ian Levitt says the family will be taking both civil and criminal action against those implicated in the forensic investigation into Enock Mpianzi’s death.

Enock drowned on his first day of Grade 8 at Parktown Boys’ High School during an orientation camp held at Nyati Bush and River Break in Brits on 15 January.

His body was only found on 17 January.

On 4 March, Harris Nupen Molebatsi Attorneys released a report detailing what took place in the lead up to Enock’s tragic death.

The report also made recommendations to hold the headmaster Malcolm Williams and five teachers accountable for their negligence in a number of matters. The Gauteng Department of Education and the school governing body were also mentioned in the report. Nyati was found to be reckless and negligent in a number of ways.

Levitt said, “The family will be taking both civil and criminal action against those implicated in the report as well as in our own investigation. If someone negligently caused the death of another human being, then that person would be liable to be convicted for culpable homicide.”

“Whilst any assistance to our investigation is always and will always be welcome, we are conscious of the limitations of the report as there were a number of people who refused to cooperate with their investigation.”

Levitt added, “Either way, these people will not be able to hide forever and everyone involved in the causing of this tragedy will be held to account.”
