Illegal liquor outlet in Lyndhurst faces closure

LYNDHURST – Legal action has been instituted against the owner of a shebeen.

Ward 81 councilor, Irene Rugheimer, said the law will come down on liquor outlets that trade illegally in the Johannesburg north-east suburbs.

This follows a recent move to shut down a problematic shebeen on the corner of Louw Street and Johannesburg Road in Lyndhurst on 6 April. According to the councillor, the shebeen has been operating in the area for a long time, trading illegally – until recently.

Rugheimer said residents started to complain about the noise coming from it, as well as littering by the patrons. “Residents have been complaining about the noise over weekends and the mess that is left on the sidewalk,” she said.

“The by-laws state that any liquor outlet should be at least 500 metres away from a school. In this case, it is only 170 meters from Mary Immaculate Nursery School.”

The matter has been taken up by the City of Johannesburg’s Building Control Department, and now legal action has been instituted, she added.

A notice of motion has been signed and sent to the sheriff of the court to serve by hand, said Rugheimer, adding that they are waiting for the sheriff to confirm the notice has indeed been served. “If the owner does not comply and terminate the unauthorised use, the matter will then be set down for enrolment on an unopposed roll in order to obtain a date of hearing from the high court,” warned Rugheimer.

To the residents, the councillor said their pleas and complaints have not gone unheard or ignored, and said she had been working on this issue for over a year and will continue until the matter is corrected.
