KENSINGTON B – Recordings from 10111 phone calls made by estate agent, Vicki Momberg, will be used in evidence regarding the charges of crimen injuria brought against her after alleged racist comments.

Momberg appeared before Randburg Magistrates’ Court on 6 September. Previously it was stated that she would be charged with another seven counts of crimen injuria culminating in a total of eight charges. The charge sheet has now reflected that she will be charged with a total of only four.

The first three counts are in connection with phone calls made to 10111 after her apparent smash-and-grab incident near Malibongwe Drive on 3 February this year. The last charge is related to the video that went viral.

In the recordings, Momberg was been cited using the ‘k’ word several times, including other insults.

During court proceedings, defence attorney, Advocate Nardus Grové stated that they intend to engage in a plea and sentence agreement with the State and asked for a provisional postponement to November.

Senior Prosecutor Yusuf Baba agreed to the postponement but objected to a lengthy waiting period. “The State is ready to make a decision… I’ve done in-depth research and we know what we want,” stated Baba.

Nardus explained that the defence was still waiting for a report from an expert, saying that it may take some time.

The defence has until 10 October to hand over the expert report. The provisional court date is set for 18 October.
