WATCH: Marthinus Pelser denied bail

ROODEPOORT – Marthinus Pelser accused of the murder of his six-month-old son, has been refused bail.

The 22-year-old man accused of murdering his six-month-old son appeared in the Roodepoort Magistrates’ court today (17 October) to find out whether or not he would be granted bail. Members of the ‘justice for baby Deon’ group yelled out in joy when Magistrate John Baloyi ruled that the court refuses bail.

Pelser looked calm during the appearance, but his family was not impressed with the ruling at all. Magistrate Baloyi read out evidence that was given to the court in order to justify his ruling. The post mortem report was read again. According to this report, the baby had burn wounds on his face and chest that caused his skin to peel. Baby Deon also had bruises on his back, neck, and legs.

The baby died due to multiple blunt force wounds to the head. His skull was fractured. The report also stated that he had bruises on his body, consistent with fingertip pressure as seen in many child abuse cases. According to the autopsy report, the assault has been going on for a long time.

Magistrate Baloyi said that he looked at the bail application in terms of a schedule six offense and therefore, exceptional circumstances needs to exist as to why Pelser should be granted bail. “The applicant’s legal team is oblivious of the court’s ruling that this is a schedule six offense,” he said.

A note found in the kitchen was allegedly written by Pelser where he apologises to the baby’s mother and said that he would always love her. This note is busy being analysed by handwriting specialists.

Magistrate Baloyi ruled that the accused failed to deliver evidence as to why bail should be awarded. Pelser was refused bail and will appear on audio-visual footage on 11 November when the case continues after investigation.
