According to Japh Chuwe, registrar of the Road Traffic Infringement Agency (RTIA), in a recently aired interview, Aarto and by extension the driver demerit system will be implemented in April.
The Administrative Adjudication of Road Traffic Offences (Aarto) was signed into law in 1998 but its implementation has continuously been postponed since. Chuwe, in a recent interview with Redi Tlhabi of 702 Radio, said RTIA is ready for its implementation.
“We are looking at [implementing in] the next financial year, which starts in April 2016,” he was quoted saying.
“Then we hope to roll out Aarto, including the points demerit system.”
The RTIA will administrate Aarto, whereby demerit points will be allocated to both drivers and vehicles. Everybody will commence, upon its implementation, with zero points.
With Aarto implemented, demerit points can be incurred in many ways. Points will be incurred when payments are made or application is made to pay in instalments for an infringement committed. Points will also be incurred when a motorist is found guilty of an infringement or offence by a court of law, or when an enforcement order is served on an infringer.
Should a motorist excheed a total of 12 points incurred, his or her driver’s license or professional driving permit or vehicle license or operator card will be suspended. The suspension period will be calculated in months equal to three times the points that exceed 12. Thereafter, demerit points will be deducted at a rate of one point for every three months, that is, if no additional points have been incurred during the suspension period.
The RTIA released a handy pamphlet that points out how 1) penalty amounts and points are calculated depending on the infringement, 2) exceeding the speed limit will be dealt with by penalty amounts and points and 3) offences, for which a summons to appear in court is served, will be dealt with in terms of penalty amounts and demerit points.
