Docket on child’s death seemingly missing

Not clear whether parents will be prosecuted for their toddler's death, as nobody can confirm where docket is.

After a docket has been sent away to court on Monday 11 January nobody has been able to confirm it reached the court nor whether the parents would be prosecuted for the death of their child.

The Roodepoort Police allegedly sent a docket regarding a toddler’s death to court in January, after statements were taken from both parents, for prosecutors to decide whether it is worth pursuing judicially. The toddler, 3, died after he fell from the balcony of their third-floor apartment in Grobler Park days before Christmas 2015. He was allegedly left home alone while his mother went out Christmas shopping.

Since the docket was allegedly sent, neither the Roodepoort Police nor two senior prosecutors at the Roodepoort Magistrate’s Court could say what the court has deliberated. The prosecutors are questioning whether the docket ever reached court, as it has not come across either of their desks and, they say, a decision would have been made before the end of January if it did arrive.

According to Roodepoort Police spokesperson Warrant Officer Nonhlanhla Khumalo she’s had no feedback from the court since the docket was sent.

“It is still with the court,” she said, adding, “we will report on any developments in the case”.

The Record is seeking clarity from the investigating officer in the case, who only took statements weeks after the death and has apparently not arrested anyone in this regard, as well as the Honeydew Cluster.
