Carolina Magistrate’s Court issues stark warning to domestic violence offenders

The court concluded that Mabuza did not respect the court and for his actions, deserved to be punished accordingly to deter others.

The Carolina Magistrate’s Court sentenced Linda Prince Mabuza (30) on 25 June, to three years’ imprisonment for contravening a protection order on 27 October 2018.

The sentence comes at a time where there is a public outcry regarding domestic violence.

In an effort to remedy the situation, the government has put in place systems, such as protection orders, to curb this scourge.

Carolina Police arrested Mabuza for contravening the protection order that was issued against him by the mother of his two children.

It is alleged that when Mabuza returned his children to their mother’s house after a visit, he became embroiled in an aggressive argument with the mother which then led to the assault.

The matter was reported to the police and a docket was subsequently opened which led to his arrest.

During trial, the court emphasised the seriousness of gender-based violence (GBV) and that there is a demand for justice and to deal harshly with offenders.

The court concluded that Mabuza did not respect the court and for his actions, deserved to be punished accordingly to deter others.

“I am delighted by the sentencing of the accused and I admire the bravery of the victim, the work done by the team of investigators, the prosecution team as well as the judiciary,” Lieut-Gen Mondli Zuma, provincial commissioner of the Mpumalanga Police, said.

“This is a step towards the realisation of a safe environment for children and women in our society.

“We believe that this sentence will serve as a deterrent to those who violate protection orders.

“This sentencing has come amidst a flood of GBV incidents where women are severely assaulted, some even killed by their spouses or boyfriends.

“We urge men to desist from perpetuating violence against women.

“Let there be tolerance among couples and if there are differences, try to seek help, do not die with a protection order in your house, report the perpetrator to the police,” Lieut-Gen Zuma concluded.
