During the bail hearing, Baloyi testified that he needed to look after his wife and three children as he is the sole breadwinner, but this was not enough for a successful application.

The state, represented by Advocate Ronald Sithada, opposed bail, stating that he failed to show exceptional circumstances and the possibility exists that he would interfere with witnesses.

Baloyi was charged along with Shumani Nemadodzi, Isaac Mudau and Tshianeo Munyai and during the course of their appearance in court, they abandoned their applications for bail.
