The Constitutional Court during a judgement on Tuesday reportedly legalised the use of dagga in private capacity.
This after the Western Cape High Court ruled that dagga should be legalised for home use in 2017 only to have the state appeal this decision thereby forcing it on the backburner for another year.
The judgement was delivered by Deputy Chief Justice, Raymond Zondo and Government now has 24 months to officially write this bill into law. However, private use does have the go-ahead as of Tuesday, according to information.
It was also learnt that it was up to government to decide what quantities would be allowed per person and that it must be strictly for the purpose of personal use.
The official status for dagga is that it is now “decriminalised,” however, dealing in marijuana, selling it to others or smoking it outside the confines of your own home remain illegal practice.
Sanca Limpopo Alcohol and Drug Centre director, Amanda Swart indicated that she could not comment on the judgement as yet as all branches had received instruction from their head office to refrain from commenting, hence they have issued a statement.
Provincial Police Spokesperson Moatshe Ngoepe referred the publication to the national Police media centre who was also not able to comment on the way forward.
