Doris Mthembi to explain her absence from high court

POLOKWANE – The Makhado Regional Court is expecting Doris Mthembi to explain why she violated a court order issued by the Polokwane High Court on 11 November which stated she should hand herself over to the police in Makhado within 72 hours.

Current serving a six-year sentence for perjury, Mthembi’s whereabouts of the last four weeks could not be established.

On 23 November, she was to have appeared in the Tzaneen Magistrate’s Court on a case of fraud, but her lawyer informed the magistrate that his client could not attend due to health reasons. The magistrate insisted on a sick note. Another sick note was submitted through her legal council when she was supposed to appear in the Retavi Magistrate’s Court on 25 November. The case was postponed.

The case against her that relates to conspiracy to murder, which was to have been heard in the Giyani Magistrate’s Court from 28 November to 1 December, was also postponed after a sick note was received.

A detective from the police in Tzaneen however arrested her on 3 December, and informed the Makhado Police.

She appeared in the Makhado Regional Court on 5 December and informed the court she wanted to acquire the services of the Legal Aid lawyers to represent her for violating the High Court order after failing to hand herself within 72 hours.

Mthembi couldn’t be reached for comment.
