Fraudster jailed for eight years

Honour for cop who helped put fraudster behind bars.

Intensive investigation into 102 fraud cases committed during the period 2010 to 2012 resulted in the successful conviction and sentencing of a 47-year-old accused, Fikile Kwenyana.

The accused was conducting a business in Randfontein called Deenin properties, also trading as Imishado Ayesekho Trading. The business premises was situated in Homestead Avenue and later moved to Park Street. The company was a property developer in Gauteng, mostly in the East Rand, West Rand and the Vaal,” said Captain Appel Ernst, spokesperson for Randfontein Police.

According to complainants the accused sold them houses that were to be built in developing suburbs in their respective areas. They were required to pay a deposit which ranged from R1 000 up to R15 000.

The agreement was never met by the accused and when confronted by the victims, they were told that the company are experiencing administrative or zoning difficulties. The respective victims then opened fraud cases when the accused could not refund their deposits.

When the cases started accumulating in Randfontein, Sergeant Nomsi Mothibi was designated to investigate the frauds totaling 38. In 2012, some of the disgruntled victims approached the “Speak out” television show and they confronted the accused. It was only then that they realized there are more than a hundred prospective home owners who were defrauded.

A total of 102 were reported and assigned to Sergeant Mothibi. Her investigation into the matter resulted in the arrest of Kwenyana on 26 February 2013.

The case was heard in the Protea Magistrates’ Court with Magistrate Johan Budricks presiding. Kwenyana and his company were both convicted on all counts.

On 30 October the investigation paid off when the company was sentenced to a R10 000 fine on each of the counts. This sentence was suspended for five years. Kwenyana was sentenced to eight years imprisonment and declared unfit to possess a firearm.

Randfontein Police management congratulates Sergeant Mothibi on her perseverance and the efforts that she made in ensuring the conviction and the subsequent sentence.
