Warning: Think again before you pawn – Randfontein police to second-hand goods dealers in town.

The Randfontein Police have issued a warning to the town’s dealers in second-hand goods, threatening to cancel their permits, or worse, should foul play be proven.

Legislation on trading in second-hand goods can be found in the Second-Hand Goods Act 6 of 2009. The Randfontein Police have confirmed there are dealers in the area who have been violating the Act.

“[A]ny contravention might lead to prosecution or even the cancellation of the second-hand goods permit,” said Captain Appel Ernst, Randfontein Police’s spokesperson.

Ernst explained that a registration may be terminated or cancelled if the permit expires and the renewal is not done according to section 11 of the Act.

“If a dealer stops trading or is unable to carry on business, it is his responsibility to immediately notify the National Police Commissioner. If a dealer fails to comply with any conditions of registration or the provisions specified in Act 6 of 2009, the Commissioner must cancel the registration. This Act also stipulates in section 10(3)(b) that the Commissioner must cancel registration if the dealer is registered on the basis of incorrect or false information or is convicted of an offence of which dishonesty is an element,” Ernst said.

Other than a permit being terminated, an imprisonment penalty is attached to the Act, which is why police say it is imperative that dealers in Randfontein comply with the conditions stipulated on their permits.

Ernst explained that there are simple rules which can be broken and result in serious action, for instance displaying goods outside the business perimeter which is stipulated in the permit.

Warrant Officer Lukas Benecke from the Randfontein Police Flash office will be conducting routine inspections to ensure compliance. “Any irregularities,” Ernst said, “will result in prosecution”.
