Final postponement in Vicki Momberg case

KENSINGTON B – State tired of delays in the Momberg case.

The Vicki Momberg case has yet again been postponed to 27 October in order to give the defence more time to finalise certain matters.

Momberg has been charged with four counts of crimen injuria. The first three counts are in correlation with phone calls made to 10111 after her apparent smash-and-grab incident near Malibongwe Drive on 3 February this year.

The last charge is related to the video that went viral.

State Senior Prosecutor Yusuf Baba explained at Randburg Magistrates’ Court today (18 October), that he had received information from Defence Advocate Nardus Grové that he would not be present due to another trial in Cape Town. Valencia Mathebula represented Grové.

Baba stated that Grové was supposed to have supplied the State with the Section 105A report (physiologist report and defence plea) by 8 October. The report could not be handed over because, according to Baba, Grové had not yet completed it.

“I have expressed my sentiments on the record before, regarding the delays in this trial. I will not do so again,” said Baba. He asked the court to set a date down for trial. Mathebula then asked for a postponement so that the report could be finalised.

The State has been waiting for the report since August. Baba argued that if in the event the report is not handed to him at the prescribed date, the court should order a trial date to be set, regardless.

Momberg’s next day in court will be 27 October, this is will be final postponement in the case.
