BREAKING NEWS: Manqele guilty of murder

RANDBURG - After a lengthy ruling, a verdict of guilty was handed down.

Sindiswe Manqele, girlfriend of Nkukuleko ‘Flabba’ Habedi has been found guilty of his murder on 9 December.

After a very lengthy explanation process Judge Sithole went through the arguments of both the State Paul Schutter and defence Advocate Norman Makhubela. Judge Sithole went through the limitations of pleading private defence as Manqele did.

“The attack must be unlawful. It must be a defensive attack against the attacker; also, the defensive attack must be necessary to protect her interests.” He added there must be a relativity between the attacker and the defender; also, she must be aware that she was attacking in private defence.

Judge Sithole added that that the accused, under the circumstances, exceeded the limits of private defence. “She admitted that she stabbed the deceased intentionally, if anything there was premeditation in her stabbing.” Judge Sithole recalls how Manqele answered his question by saying, “Ya, I did stab him so that I could get away from him.”

She foresaw that the knife would enter his heart, “I just wanted to hurt him, I was pushing him away from me; the knife was in my hand, she admitted to knowing the possibility.”

Judge Sithole found that her reason was not probable and “her private defence was exceeded by stabbing him unlawfully.” It was corroborated by Doctor Thandi Mahuluhulu’s testimony when she stated, “The nature of the stab wound to the chest cavity is, ‘consistent with considerable force’.”

Earlier he had said it is clear that the relationship was one of love but became one made of altercations and of disagreements. It is no surprise why this relationship ended in failure and the death of one of the partners. It originated from extreme mutual jealousy and the financial status of Flabba. The tension of the relationship reached a pinnacle inside the room of Flabba. The altercation culminated in the fatal stabbing of the deceased.

Court has adjourned for 15 minutes in order for Manqele’s legal team to obtain a formal bail application from her Defense Advocate Norman Makhubela.
