Day 6 : Defence questions Constable Malaka

KENSINGTON B – Investing officer is cross-examined on his procedural inaccuracies.

Day six of the murder trial of Flabba’s girlfriend Sindisiwe Manqele, continued at Randburg Magistrates’ Court on 14 September.

Masego Tsele, girlfriend of Nkululeko Chauke, who was also present at The Sands Club the night before Nkululeko ‘Flabba’ Habedi’s death, took to the witness stand.

Tsele was questioned by defence attorney Norman Makhubela on her sobriety on the night.

She said, “Myself and the accused were drunk but the deceased was not.”

Tsele also confirmed that Manqele and Flabba had both smoked marijuana that night.

Investigating officer (IO) of Alexandra Police Station, Constable Seila Malaka also testified.

Makhubela argued that Const Malaka followed incorrect procedures when taking Manqele’s statement.

He said that the accused wanted a lawyer present before making a statement as indicated on the statement form.

Const Malaka said, “The accused said she wanted a (public defender) because she wasn’t sure how deep her pockets went, when she goes to court.”

Makhubela insinuated that Const Malaka is biased and was more interested in ‘cracking the case’ than following correct police procedure.

In among other arguments made by the defence, Makhubela questioned why Const Malaka did not put in the statement that Manqele was limping and that she was injured in her abdominal area, even though she had indicated to the area.

The state then closed its case.

Makhubela confirmed that Manqele will take to the witness stand and they will call at least three witnesses to testify.
