Axe man off the hook, for now

KENSINGTON B – Axe man's case has been struck off the role at Randburg Magistrates' Court.

Randburg’s axe man can breathe a sigh of relief, while he waits for State prosecutors to ‘get their act together’.

The man accused of striking a fellow motorist with an axe three times in Randburg in November last year, heard at the Randburg Magistrates’ Court, Kensington B, on 27 February that his case has been struck off the role until the State can finalise its investigations.

The man was charged with assault with intent to do grievous bodily harm for his actions in the road rage incident.

Neither he, nor his legal representative nor his family were willing to speak to the media.

The State prosecutor began by asking Magistrate Hanlie Banks for a postponement on the case, as some statements were missing from the docket. The man’s legal representative responded by saying that it was the accused’s fourth appearance, and because the case had taken so long to start, the matter should be struck off the role.

“The State haven’t got their act together…” he said in court. “My client’s Constitutional right to a fair trial is being violated.” Magistrate Banks granted the request, but only until the State’s investigations are finalised, at which point the man will appear in court again, facing his charges. Two Netcare 911 paramedics, who attended the scene, were suspended by their company for allegedly assisting the man, who is white, and not the injured black motorist.
