Three suspects convicted for housebreaking, theft and robbery by Randburg Magistrate’s Court

Suspects have been convicted for two different cases.

A 2020 and 2021 case has been closed after three men were sentenced in the Randburg Magistrate’s Court for two different cases.

According to the Linden Police Stations communication officer, Sergeant Takalani Sibiya, accused one Thabiso Chris Hlaka and accused two Thabiso Phasha were sentenced to two years for the offence of housebreaking and theft, to wit: one Ford car keys, one lamp, a Fitbit smartwatch, earrings, bracelet, prescription spectacles, large knives, comforter blanket, necklace, and a ring worth R10 000.

Accused one Thabiso Chirs Hlaka was sentenced to 12 years’ imprisonment.

“The court ordered those two years’ imprisonment of this sentence is to be served concurrently with the sentence that the accused is currently serving. The accused is convicted of a serious premeditated dishonesty offence. No other determination is made and in consequence, the accused remains unfit to possess a firearm.”

Accused two Thabang Phasha was sentenced to 12 years’ imprisonment of which five years’ imprisonment was suspended for five years on the condition that the accused was not convicted of:

  1. Housebreaking with the intent to steal and theft or
  2. Housebreaking with the intent to steal or
  3. Housebreaking with the intent to steal and attempted theft or
  4. Housebreaking with the intent to commit an offence unknown to the prosecutor or
  5. Attempted house-breaking with the intent to steal or
  6. Theft or
  7. Attempted theft or
  8. A contravention of section 36 or
  9. Housebreaking with the intent to rob and robbery which is committed during the period of suspension and to which the accused is sentenced to imprisonment without the option of a fine.

Accused three Sipho Ziyana was sentenced for a case of robbery with a firearm, and receiving stolen property to wit: a Samsung note 10, a Lenovo laptop, a GoPro camera, remote control and battery, a wallet, a Toyota Yaris registration HL OO GN GP.

“The accused was sentenced to R25 000 or five years’ imprisonment, as well as five years’ imprisonment which is suspended for five years on the condition that the accused is not convicted of:

  1. Robbery or
  2. Theft or
  3. Attempted theft or
  4. A contravention of Section 36 (possession of stolen property) or
  5. A contravention Section 37(1)(a) (receiving stolen property) committed during the period of suspension and to which the accused is sentenced to direct imprisonment without the option of a fine.”

The accused was declared unfit to possess a firearm.
