How can motorists claim damage caused by a pothole?

Find out how you can claim for your vehicle, private property and other road or stormwater infrastructure damages from JRA.

Have you ever been in a situation that was far beyond your control and then later have to deal with the consequence?

Like driving into a pothole and dealing with the expense of getting a new tyre or having a pothole outside your property making it harder for you to leave or enter your house.

Johannesburg Road Agency (JRA) media officer Kelebogile Mafa shared information about claims provided by JRA’s legal department. “The JRA’s Legal Department is responsible for receiving and registering claims applications for damage(s) to vehicles and private property, or personal injury arising from or caused by the road or stormwater infrastructure maintained by the JRA on behalf of the City of Johannesburg,” Mafa said.

In the unfortunate event of such an incident, she explained that the affected parties – such as motorists, residents and pedestrians – could submit a completed claim form. The form can be obtained from the JRA’s website, filled in with the required information along with the applicable documents and submitted via email to claims@jra.org.za.

Alternatively, hand submissions can be delivered to JRA’s head offices on 75 Helen Joseph Street, Johannesburg.

The following documents must be attached to the claims form:

  • Claimant’s certified ID copy.
  • Police affidavit and confirmation of non-insurance (if applicable).
  • Three recent repair/replacement quotations of the damages.
  • Invoice should the claimant have replaced tyres or fixed the vehicle damage.
  • Damage report from the supplier/repairer confirming the items which are damaged.
  • Photos of the damages (colour photos are preferable)
  • Photos of the pothole and location on the road (colour photos are preferable) (if applicable).
  • Copy of the motor vehicle licence certificate and vehicle registration certificate.
  • Copy of the purchase invoice of the original damaged tyre(s). Please retain the damaged tyres should an inspection be required (if applicable).
  • Towing invoice to validate if claiming two tyres or more.

Mafa emphasised that claims for accidents and injuries that occurred on roads or infrastructure maintained by JRA will be lodged with the agency but claims outside the Johannesburg jurisdiction or on provincial or national roads will be processed by the departments mandated to repair and maintain those roads.

JRA encouraged affected parties to apply immediately after the incident. Following the Prescription Act, claims older than three years from the date of the incident won’t be accepted.
