Councillor’s Corner: Overcrowding of properties

JOBURG – Read this weeks' question in Councillor's Corner.

Darren D from Johannesburg asked:

I would like to know what the bylaws are around the maximum number of people per house? I have noticed that people will rent out all the rooms in a house, like the living room and family room.

Please advise if there is a maximum number of people allowed to reside in a house and if there is a process to resolve this issue?

David Potter, Ward 102 councillor, answered:

When such instances are noticed by community and resident associations, it is best to report the matter to the City of Johannesburg through the ward councillor who will request the Land Use Management Department, under Development Planning Department, to open an investigation.

A site visit by the City will then take place to determine if the rights granted to the particular property are being complied with.

The City will then take necessary action, which can take some time, until a conclusion is reached. Furthermore, the City has a penalty rates tariff which is also used as a mechanism to ensure property owners comply with rights granted in terms of the title deed or further consent use approvals.
