Closing arguments continue for #Flabba

KENSINGTON B – Advocate Paul Schutter presents his closing argument.

Randburg Magistrates’ Court saw the closing argument of Advocate Paul Schutter for the State regarding the death of Nkululeko ‘Flabba’ Habedi on 23 November.

Adv Schutter opened by saying that there must be a holistic approach for the circumstantial evidence in this case. He argued that Manqele contradicted herself when testifying to her alcohol and marijuana intake the night before his death. “My Lord, she is painting the deceased in a bad way to use it as a motive for his behaviour later on.”

He further argued that she had lied about being jealous of Flabba’s ex-girlfriend Kia so that her version of him being the aggressor would be true. Also her version that Flabba used a knife to enter the room is also improbable because witness evidence from the two men present at the home said they did not see a knife in his hand. Adv Schutter argued that Sindiswe had left the room when Flabba had thrown her bag out. She went to the kitchen where she placed the MacDonalds meal in the fridge; this is when she retrieved the knife.

“It is clear that if the deceased wanted to stab her it would have not taken much effort and her wounds on her stomach were superficial.” Adv Schutter argued that her version of fighting for the knife is improbable because she did not sustain any wounds on her hands.

Among other inaccuracies Adv Schutter submitted that her version be rejected due to the improbability. “She waited to see his reaction after she stabbed him, that My Lord is not the actions of a person fearing for their life.”

“I put to the court that her version should be rejected beyond all reasonable doubt.”

Court has adjourned for tea.
