Simba case postponed for expert report

KENSINGTON B – Magistrate approves State's request for a provisional postponement.

The case involving the death of Simba Mhere and Kady-Shady O’Bryan was postponed in the Randburg Magistrates’ Court on 18 August.

Senior prosecutor for the State Yusuf Baba said in court, “I intend to consult with the father of the accused as I have a statement on record. I will then need the necessary permission from his counsell.” He asked for a postponement in order to receive a report from an accident reconstruction expert and for this report to be given to the defence.

Satch Govender, defence attorney for the accused Preshalin Naidoo, agreed to the postponement.

Ryan Harrison of RE Harrison Attorney representing the Mhere and O’Bryan family said, “I have spoken to both the families. They are still happy with the process but would be happier to have an actual trial date.” He further stated, “The families said they need closure as they currently feel like they are in limbo.”

The case has a provisional date set down for 26 August.

Previously, on 23 July, the case was postponed to this date for further instructions from the defence to counsel.
