Court rules that self-defence resulted in man being killed

Magistrate Ferreira said the court was satisfied that Michael Gounden (28) had defended himself when he and Naidoo became 'embroiled in a quarrel' in June 2019.

A man was sentenced to five years’ imprisonment after the court heard he had acted in self-defence in a scuffle that resulted in the death of Jason Devanand Naidoo (27) in Glencoe.
In his ruling, Magistrate Ferreira said the court was satisfied that Michael Gounden (28) had defended himself when he and Naidoo became ’embroiled in a quarrel’ in June 2019.
Defence Advocate Barnard persuaded the court that Gounden had done what he could to protect himself during the altercation, while State Prosecutor Sithole argued that Naidoo had left behind two young children following his death.
The defence will not appeal the sentence.
Meanwhile, teacher Werner Botha appeared briefly in the same court on Monday, accused of sexually assaulting a school girl at Dundee High School in February.
He too is represented by Advocate Barnard. The case was remanded to June 26-28, 2023, for trial.
