Madadeni Court hands rapist three life sentences plus 12 years

The third complainant went to the man's house for a traditional ceremony. She tried to flee after everyone had left, but he locked her in the house:

A rapist who attacked a woman and later forced her to sleep between him and his daughter was sentenced to three life sentences and an additional 12 years for the rape, kidnapping and assault of three women. The women were aged 17, 27 and 40. The rapes were carried out between May and November 2019.

The 46-year-old, who was not named, appeared before the Madadeni Regional Court.

Natasha Ramkisson-Kara, NPA Regional Spokesperson (KZN Division), said in the first incident he (the suspect) had requested that the woman assist him carrying home his grocery bags to which she agreed because she knew him.

He raped her after closing all of the doors and windows of his house. She eventually managed to escape after one of his friends came over to smoke drugs with him.”

The second complainant had allegedly walked past his house and stopped for a drink of water. He invited her inside before locking all the doors and windows.

When she refused to have sex with him, he assaulted and raped her. His daughter returned home, and despite the woman reporting the attack to the daughter, she was ignored.

The man forced her to sleep between him and his daughter and continued to rape and assault her throughout night. When she attempted to flee, she was severely beaten and raped again.

She eventually managed to flee to a neighbour’s house, where he pursued her and assaulted her again. She had sustained multiple open wounds and lacerations to her entire body. However, the neighbours eventually persuaded him to leave her alone.”

The third complainant went to the man’s house for a traditional ceremony. When everyone had left, he stopped her from fleeing, locked her in the house and preceded to rape her.

He kept her overnight and then escorted her home the next morning. He was arrested shortly after she reported the incident at home.

All of the complainants were taken to the Madadeni Thuthuzela Care Centre, where they received psycho-social services, counselling, and support.

Regional court prosecutor, Bonginkosi Dan Motha, led the complainants’ evidence in court, as well as DNA evidence linking the man.

Motha also provided victim impact statements, which were compiled by the complainants and facilitated by court preparation officer, Masande Mdiya.

They all stated that the events had permanently altered their lives.

Two of them mentioned that they had become drug users in order to forget what had happened to them and sleep. They also stated that they are afraid of men and are embarrassed to be in public.

The National Prosecuting Authority applauds the successful conclusion of this case because it demonstrates our commitment to combating the scourge of gender-based violence. We applaud the work of the prosecution and SAPS.”
